When a California attorney needs business records for a case — medical files, employment records, bank statements, insurance claims — the deposition subpoena (Judicial Council form SUBP-010) must designate a neutral deposition officer to receive the records from the custodian. Under California Code of Civil Procedure § 2020.420, that officer must be a registered professional photocopier or a person exempted by law — which includes registered process servers.

Step 2 — We Serve the Custodian of Records

We serve the custodian of records with the subpoena and any required notices. Under Evidence Code § 1563, custodians have 15–20 days to produce records. We track deadlines and follow up on compliance.

Step 3 — Records Arrive at Our Office

The custodian delivers records with a signed Custodian’s Declaration (Evidence Code § 1561). We log receipt, secure the sealed materials, and notify your office immediately.

Step 4 — Certify, Bates-Stamp, and Deliver

For full-service engagements we Bates-number each page, certify the copies, scan to searchable PDF, and serve copies on all counsel of record per CCP § 2020.420(c). Originals are returned to the custodian when required.

Step 5 — Close the File

You get a complete chain-of-custody packet: proof of service on custodian, custodian’s declaration, Bates-stamped certified copies, and our officer’s declaration. Everything your record needs to hold up in court.

Deposition Officer Only — $250 flat. SACRPS is named as the deposition officer on the subpoena, calendars the records date, manages receipt of the custodian’s response, scans the documents on- or off-site, and delivers a secured, encrypted PDF copy to counsel via email. Pursuant to Evidence Code § 1560(e), Code of Civil Procedure § 2020.420, and Business and Professions Code § 22451(g).

Officer + Subpoena Service — $400 flat. Everything in Deposition Officer Only, plus SACRPS personally serves the custodian of records with the subpoena. Our Sacramento County process server registration lets us combine the two services on a single invoice — no second vendor, no separate service fee.

Full-Service Records Subpoena — $575 flat. Complete workflow: SACRPS drafts the SUBP-010 subpoena and any required SUBP-025 consumer/employee notices, serves the custodian, acts as deposition officer, scans and certifies records, and delivers encrypted PDF copies to all counsel of record. One call, one invoice.

Rush Full-Service (5 business days) — $675 flat. Full-service package on an expedited timeline. We serve the custodian within 24 hours and prioritize the return.

Certificate of No Records / Cancellation — $75 flat. Admin fee when the custodian reports no responsive records or the job is canceled after issuance.

If you prepare your own documents, you assume full responsibility for their accuracy, compliance, and legal sufficiency. SACRPS is not liable for errors in client-prepared documents that may delay, impair, or void service or production.

Do I have to use a deposition officer for a document subpoena?

Yes. California Code of Civil Procedure § 2020.420 requires a deposition subpoena for production of business records (SUBP-010) to designate a neutral deposition officer. The officer must be a registered professional photocopier or a person exempted under Business & Professions Code § 22451 — registered process servers qualify.

Can SACRPS both serve the subpoena and act as the deposition officer?

What does the $250 Deposition Officer Only fee include?

It does not include drafting the subpoena, preparing consumer/employee notices, serving the deponent, or any copy fees the deponent charges. Those are covered in the $400 and $575 tiers.

What if the custodian has no records?

If the custodian returns a Certificate of No Records or declares no responsive documents exist, we charge a $75 flat admin fee and close the file with the CNR documentation for your records.

How fast is rush service?

Rush full-service is 5 business days from subpoena receipt. We serve the custodian within 24 hours and follow up daily until records are produced. Custodian response time is outside our control, but we push hard to hit the deadline.

Do you deliver records electronically?

Yes. Full-service engagements include Bates-stamped PDF delivery to all counsel of record via secure link. Originals are returned to the custodian when required by the subpoena.

Do you handle SUBP-025 consumer and employment notices?

Yes. Our full-service tier includes drafting and serving SUBP-025 notices to consumers under CCP § 1985.3 and to employees under CCP § 1985.6 when the records involved require that notice.
