Out-of-State Subpoena Domestication Under California’s UIDDA
California adopted the Uniform Interstate Depositions and Discovery Act under Code of Civil Procedure sections 2029.100 through 2029.900. The UIDDA streamlines the process of enforcing out-of-state subpoenas by eliminating the need for a California attorney to issue the subpoena or file a miscellaneous case.
Under the UIDDA, the process is straightforward: submit the original out-of-state subpoena along with a completed Application (form SUBP-030) to the clerk of the Superior Court in the county where the discovery will take place. The clerk issues a California subpoena that mirrors the terms of the original. That domesticated subpoena is then served under California rules. California’s UIDDA applies to subpoenas from all 50 states plus the District of Columbia.
