How to Subpoena Instagram Records & Unmask a Fake Account ($395 Flat)

Short answer: Instagram records are held by Meta Platforms, Inc., and Meta’s California registered agent is in Sacramento. Your out-of-state subpoena must be domesticated in a California court before it has any force.

We are a Registered California Process Server (2024-027) in Sacramento. Meta’s agent is about ten minutes from our office. We domesticate and serve. $395 flat.

Exactly Who You Serve

Entity: Meta Platforms, Inc. — not “Instagram” and not “Facebook, Inc.” Registered agent for service of process in California:

Corporation Service Company (CSC), 2710 Gateway Oaks Drive, Suite 150N, Sacramento, CA 95833

The mistake that gets Instagram subpoenas rejected

Facebook, Inc. no longer exists under that name — it became Meta Platforms, Inc. in 2021. Subpoenas still go out every week captioned to “Facebook, Inc.” or addressed to “Instagram, Inc.” and get bounced. Caption it Meta Platforms, Inc.

Meta publishes law-enforcement guidelines but no civil-litigant guidance at all — it points private parties to a Help Center page that loops back to the law-enforcement guidelines. That is why this is so confusing, and why so many subpoenas to Instagram simply fail.

What Records You Can Actually Get

Almost every civil Instagram subpoena is about identifying who is behind an account — a harassing account, an impersonation account, a fake account posting defamatory content, or an anonymous account in a family law matter.

  • Subscriber and registration information — email, phone number, account creation date
  • IP address logs with timestamps — the unmasking evidence
  • Account status, linked accounts, and login history

What you cannot get. The federal Stored Communications Act (18 U.S.C. §§ 2701–2712) bars providers from disclosing the contents of communications to civil litigants. No subpoena, however well drafted, will get you private messages. That means no DMs, no deleted posts, no photos on a civil subpoena. If someone tells you they can subpoena Instagram direct messages in a civil case, they are wrong.

Screenshot the public content now, before it is deleted — you can authenticate that yourself. And move quickly: IP logs are not retained forever.

How Domestication Actually Works in California

California adopted the Uniform Interstate Depositions and Discovery Act at Code of Civil Procedure sections 2029.100 through 2029.900. You do not need California counsel, and you do not open a miscellaneous case.

  • Submit the foreign subpoena to the clerk of the Superior Court in the county where discovery takes place — for CSC, that is Sacramento County.
  • File Form SUBP-030 (Application for Discovery Subpoena in an Action Pending Outside California) with the correct California subpoena: SUBP-035 for business records, SUBP-040 for personal appearance, or SUBP-045 for both.
  • The clerk issues a California subpoena mirroring your out-of-state subpoena. Court filing fee: $45.
  • The California subpoena is served under California rules — on Meta’s registered agent.

The Trap That Voids Most Out-of-State Subpoenas

Code of Civil Procedure section 1985.3 — the Notice to Consumer. If you are seeking records about an individual, you must serve that person (or their attorney) with the subpoena and a Notice to Consumer before the custodian is served — at least 5 days before, and at least 10 days before the production date. Miss it and your subpoena is defective, and the custodian may refuse.

Out-of-state attorneys blow this constantly, because their home state has no equivalent. We handle the notice and prove it up.

Under section 2020.410(c), the production date cannot be earlier than 20 days after the subpoena is issued or 15 days after it is served, whichever is later. Calendar the later one.

Frequently Asked Questions

Can I subpoena Instagram DMs?

No. The Stored Communications Act bars civil litigants from obtaining content, including direct messages. A search warrant is required, which is not available in a civil case.

Can I find out who owns a fake Instagram account?

Yes — this is the main civil use. The registration email and IP logs are what identify the account holder.

Do I caption it to Instagram or to Meta?

Meta Platforms, Inc. Captioning to “Instagram, Inc.” or “Facebook, Inc.” is a common reason subpoenas are rejected.

Do I need a lawsuit on file?

Yes. A subpoena issues out of a pending action, though some states permit a pre-suit petition to identify an anonymous defendant.

Will Instagram tell the account holder?

Meta’s policy is to notify users of legal process where permitted. Assume they will find out.

How fast can this move?

Five business days standard, three on rush. Given that IP logs age out, rush is often the right call.
