Step 3: You Get Proof of Service

Can I serve my own divorce papers?

No. California law prohibits the petitioner from personally serving divorce papers on the respondent. The person who serves the documents must be at least 18 years old and not a party to the case. If the respondent actively avoids service, your process server will document each attempt. At minimum, you’ll need the Petition for Dissolution of Marriage (FL-100) and the Summons (FL-110). Many petitioners also serve the Declaration Under Uniform Child Custody Jurisdiction and Enforcement Act (FL-105) and a blank Response form (FL-120).
